TERMS AND CONDITIONS

  1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over who are existing Myer One members (or who sign-up to become a Myer One member at any Myer store or online between 17/02/2012 and 09/04/2012 and who are available to travel between 20/04/2012 and 12/05/2012 (the exact dates of the trip are to be determined by the Promoter, and may change depending on Jamie Oliver’s schedule).
  3. Employees (and their immediate families) of the Promoter, Myer, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Promotion commences on 17/02/2012 and ends at close of business (for in-store entries) and at 11:59pm AEDST (for online entries) on 09/04/2012 .
  5. To receive an automatic entry in the draw, individuals must purchase any Jamie Oliver Tefal cookware product from either:
    1. a participating Myer store in Australia, and have a staff member swipe their Myer One card at the time of purchase during the Promotional Period; or
    2. the Myer online store (www.myer.com.au), and enter their Myer One card details at checkout during the Promotional Period,
  6. Multiple entries permitted, subject to the following: (a) only one entry permitted per Qualifying Transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.
  7. Entrants must retain their original Myer purchase receipt(s)/invoice(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s)/invoice(s) must clearly specify the store of purchase as Myer, that a Jamie Oliver Tefal cookware product was purchased, and that the purchase was made during the Promotional Period but prior to entry.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. Incomplete purchases will be deemed invalid for the purposes of entry. Incomplete, indecipherable or illegible Myer One registrations will be deemed invalid for the purposes of entry.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. The draw will take place at ESUS Communications, 30 Aberfeldy Close, Charlestown, NSW 2290 on 11/04/2012 at 3:00pm AEST.
  12. The winner will be contact by telephone and in writing within two days of the draw and their name will be published in The Australian on 13/04/2012.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. The first valid entry drawn will win a trip for two (2) adults to London, United Kingdom for the Ultimate UK Jamie Oliver Experience valued up to AU$48,000, depending on the date and point of departure. The prize will include:
    • Return economy airfares from winner's nearest capital city to a major airport in London, UK (as determined by the Promoter in its absolute discretion) for two (2) adults;
    • Six (6) nights twin share accommodation in a 3.5 star hotel selected by the Promoter;
    • The following daily activities:
      • Day 2: Brunch at Fifteen (with a set menu determined by the Promoter), a tour of the kitchens, and then dinner at Jamie’s Italian (with a set menu determined by the Promoter);
      • Day 3: a cooking class and lunch at Recipease, followed by a trip to the Borough market for a “foodie” shopping tour;
      • Day 4: a Ministry of Food style cookery class at Nile Street, and dinner at Fifteen (with a set menu determined by the Promoter);
      • Day 5: early lunch at Jamie’s Italian (with a set menu determined by the Promoter), followed by a butchery demonstration at Barbecoa;
      • Day 6: a “Meet and Greet” with Jamie Oliver, and the opportunity to obtain an autograph and have a photograph taken with Jamie Oliver.

    Spending money, any additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, transfers to and from tours,items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken on the dates stipulated by the Promoter in clause 2 and is subject to booking and flight availability.

  15. The winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
  16. The winner and their companion must depart from and return to the same departure point and travel together.
  17. Itinerary to be determined by the Promoter in its absolute discretion, and the winner (and their companion) must agree to adhere to the tour schedule.
  18. Prize is subject to the standard terms and conditions of individual prize and service providers.
  19. Frequent flyer points will not form part of the prize.
  20. The winner may be required to present their credit card at time of accommodation check in.
  21. If for any reason the winner does not take the prize (or an element of the prize), then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
  22. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
  23. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  24. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  25. If the prize remains unclaimed by 16/04/2012 an unclaimed prize draw will take place at the same time and place as the original draw. The first valid entry drawn and successfully contacted by phone and in writing will win the prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, the Promoter will contact the next drawn winner until a prize winner is determined. Results will be published in The Australian on 18/04/2012.
  26. The “Meet & Greet” provides the winner their companion with an opportunity to meet Jamie Oliver, and an opportunity to obtain and autograph and have a photograph taken with Jamie Oliver. These elements of the prize are not guaranteed and are subject to the goodwill of Jamie Oliver on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.
  27. Total prize pool value is up to AU$48,000.
  28. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  30. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  31. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  32. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  33. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of Jamie Oliver is cancelled/postponed for any reason beyond the reasonable control of the Promoter; or (f) participation in prize/taking of the prize.
  34. As a condition of accepting the prize, the winner and their companion must each sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
